OFD 7: NAhJCk <br />A public hearing was held at 7:15PM to consider amending Chapter 263 of <br />the Hugo City Code, through adoption by reference Washington County's <br />Individual Septic System Treatment. Ordinance. The public hearing was <br />opened, and Dean Atkinson, a sewer installer-, addressed certain conditions <br />of the ordinance. <br />Leroux made motion, Miron seconded, to recess the public hearing until <br />June 21, 1.99=:, 7:05 PM, for further clarification of the proposed <br />ordinance. <br />All aye. Motion Carried. <br />MINING PERMIT RENEWAL <br />Dean Atkinson, 1.3542 Goodv:iew Ave. North, applied for renewal of h.i.s. <br />mining permit for the SW 1/2 o..f Section 21, l31h,, R21W5 City of Hugo, <br />Washington County, Minnesota. This permit received substantial review <br />during reissuance in 1992. During that review, the City amended the <br />mining permit to disallow an;: crushing or processing of recycled asphalt <br />and concrete on the property. Mr. Atkinson has questioned the validity of <br />such a prohibition. Staff recommends renewal of the mining permit for a <br />one-year period, cont.i.ngent upon the City's receipt of security in the <br />amount of $17,500 for reclamation of the mined property, and proof of <br />current insurance, as required by Paragraph 25 of the permit. Council <br />member Miron stated that the crushing/processing of recycled asphalt be <br />addressed in 1994, at which time another public hearing will be held. <br />Miron made motion, Brunott.e seconded, to renew the Mining Permit for Dean <br />Atkinson for the SW 1/2 of Section 23, T31N, R21W, subject to the City' <br />receipt of security in the amount. of $17,500 for reclamation of the mined <br />property, and proof of current. insurance. <br />All aye. Motion Carried. <br />Mr. Pat'.r.i.ck:. Farrell, 5238 Frenchman Rd., has requested site plan approval. <br />to construct a 4' X 24' detached garage on his property located at the <br />above address. This property is zoned CB. Mr. Farrell maintains a <br />residence on this parcel as a legal nonconforming use. Site plan approval <br />is required for all construction in a CB district. The proposed garage <br />meets all setback; requirements of the City. Mr. Farrell has requested a <br />refund of the `i;85.00 site plan application fee as site plan approvals are <br />not normally required of residential property in the City. Staff <br />recommends approval of the site plan and refund of the $85.00 fee. <br />
