Verbal permission has been granted from John <br />Sadowski, adjacent property owner. Property presently zoned Single Family <br />Urban - tabled at last meeting for lack of quorum. <br />Spitzer explained the building code requirement for side yard set -back <br />in SFU zoning is 10' - said one (f the reasons is for fire protection - city <br />has been extremely reluctant to grant variances of this type - realizes he <br />has a particular problem; the loss of a very large tree, and this could be <br />considered a geographic constraint - but the possible fire hazard must be <br />considered first. Spitzer said it may be necessary to obtain a deed rest- <br />riction from the neighbor that he wont build anything any closer than 17' <br />from his property line in order to prevent a fire hazard. Applicant was <br />instructed to obtain a layout, with dimensions, of the existing buildings <br />on the west side of his property and bring his neighbor, or his agent, to <br />the next meeting. Matter tabled until meeting of June 9th, secretary in- <br />structed to put Mr. Johnson on the agenda that evening and applicant to <br />fairnish the above requested information. <br />lilliam. O'Mara <br />William O'P.Zara, 18234 Elmcrest Avenue North, Forest Lake, appeared <br />regarding five acre tract he owns la miles east of Hwy 61 off of 165th <br />Street. Property has no road frontage; is serviced by an easement only. <br />Brought in Certificate of Survey dated October 12, 1970, contract for <br />Deed dated August 4, 1972 showing him as the purchaser as of that date, <br />and proof of a perpetual, non-exclusive easement over the West 66 feet of <br />the property. <br />Secretary directed to write letter to City Attorney sending copies <br />of the above mentioned items stating that we have a request from Mr. 01114ara <br />to clarify the status of Tract C as shown with regard to access over the <br />private driveway shown as a 66' easement.
