the Premises without any manner of hindrance from Lessor or any <br />person or persons lawfully claiming the Premises. Lessor <br />represents that it has the right to enter into this Lease. <br />XVI. <br />DESTRUCTION OF DEMISED PREMISES <br />That in case the home on said demised premises shall be <br />destroyed, or be so injured by the elements of any cause, as to <br />be untenantable and unfit for occupancy and the Lessee, in its <br />sole discretion, decides not to rebuild, provided; however, that <br />if the house on the demised premises is destroyed in an amount <br />greater than fifty (500) percent of its value, it is agreed that <br />the house will not be rebuilt, then, the liability of said Lessee <br />for the rent of said premises thereafter, and all of Lessee's <br />right to the possession thereof, shall at once cease and the <br />Lessor shall pay the Early Termination Payment described in <br />paragraph 4 and Schedule A. If the Lessee decides to have the <br />home rebuilt, the Lessor agrees to do the reconstruction or cause <br />the reconstruction to be done in a timely manner and to provide <br />temporary housing to the Lessee while the reconstruction is being <br />done. <br />XVII. <br />BINDING EFFECT <br />IT IS MUTUALLY AGREED, that this Lease and all the <br />covenants, provisions and conditions herein contained shall inure <br />to the benefit of and be binding upon the heirs, personal <br />representatives, successors and assigns, respectively, of the <br />parties hereto, provided, however, that no assignment by, from, <br />through or under Lessee in violation of the provisions hereof <br />shall vest in the assigns any right, title or interest whatever. <br />XVIII. <br />NO PARTNERSHIP/JOINT VENTURE <br />Lessor does not, in any way or for any purpose, become <br />a partner of Lessee in the conduct of its business, or otherwise, <br />or joint venture or a member of a joint enterprise with Lessee. <br />XIX. <br />PARAGRAPH HEADINGS <br />The paragraph headings are inserted only as a matter of <br />convenience and for reference and in no way define, limit or <br />describe the scope or intent of this Lease nor in any way affect <br />this Lease. <br />XX. <br />SEVERABILTIY <br />3 <br />
