permitted under Section 4 within thirty (90) days of <br />the receipt of Lessor's notice. <br />Remedy. If an Event of Default occurs, Lessor may <br />terminate this Lease and recover possession of the Premises. <br />This remedy shall be Lessor's sole remedy in the event Lessee <br />fails to perform Lessee's obligations under this Lease or fails <br />to observe a restriction set forth in this Lease. <br />XIII. <br />NOTICES <br />Any notice or consent required to be given by or on <br />behalf of either party to the other shall be in writing and shall <br />be sent to Lessor at the address specified below, and to the <br />Lessee at the address specified below, or the Premises, or such <br />other address as either party may from time to time designate as <br />its notice address by notifying the other party thereof. Notice <br />so sent shall be deemed given: (a) when personally delivered; or <br />(b) on the first business day following deposit with Federal <br />Express or a comparable overnight air courier service providing <br />written evidence of next day delivery; or (c) five (5) business <br />days following deposit in the United States mail, if notice is <br />sent by registered or certified mail, with return receipt <br />requested, first class postage prepaid. <br />If to Lessee: If to Lesser: <br />Bruce and Virginia Bernin City of Hugo <br />6540 Hugo Avenue North <br />Hugo, MN 55038 Hugo, MN 55038 <br />XIV. <br />EMINENT DOMAIN <br />In the event the Premises or any part thereof shall be <br />taken or condemned either permanently or temporarily for any <br />public or quasi public use or purpose by any competent authority, <br />this Lease shall remain in full force and effect and Lessor and <br />Lessee shall each be entitled to claim and recover from the <br />condemning authority the damages to their respective interests in <br />the premises. <br />XV. <br />QUIET ENJOYMENT <br />Lessor hereby warrants that if Lessee shall perform all <br />the covenants and agreements herein stipulated to be performed on <br />Lessee's part, Lessee shall at all times during the continuance <br />hereof have the peaceable and quiet enjoyment and possession of <br />5 <br />
