SECOND AMENDMENT TO LEASE <br />This amendment to lease ("Amendment") is made this day of June, 2016. <br />by and between THE CITY OF HUGO, a Minnesota municipal corporation ("Lessor") and <br />BRUCE A. BERNIN and VIRGINIA R. BERNIN, husband and wife (collectively, "Lessee"). <br />RECITALS <br />A. Lessor, as lessor, and Lessee, as lessees, are parties to that certain Lease dated May 7, 2002 <br />(the "Lease") relating to the residential home located at 6540 Greene Avenue North, Hugo, MN <br />55038. <br />B. Lessor and Lessee recognize and remain bound to the original Lease Agreement and the <br />Amendment to Lease Agreement dated July 24, 2009, with exception of the following changes <br />herein in this document titled "Second Amendment to Lease." <br />C. Lessor and Lessee desire to amend the Lease and Amendment to Lease as specifically set <br />forth herein. <br />NOW, THEREFORE, in consideration of the foregoing recitals and for other good and <br />valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties <br />hereto hereby agree as follows: <br />1. Recitals. The foregoing recitals are true and correct, and are hereby incorporated herein <br />and made a part of hereof. <br />2. Definitions. Any term or phrase as used herein with an initial capital letter shall have the <br />means as defined herein , or if not so defined, shall have the meaning as set forth in the <br />Lease, as amended. <br />3. Second Amendment to Lease. The Lease and Amendment to Lease are hereby amended <br />and supplemented as follows: <br />a. Amendment to Section III — Extension of Term. The term of the Lease is hereby <br />extended for an additional five (5) years. The term of the Lease shall expire on June <br />30, 2022. <br />4. General Provisions. Except as amended by this Amendment, all of the terms, conditions <br />and covenants contained in the Lease shall remain in effect and be binding upon the Lessor and <br />Lessee at the time and in the manner therein provided. This Amendment applies to, insures to the <br />benefit of, and binds all parties hereto and their respective successors and assigns. This <br />Amendment shall be construed and interpreted in accordance with the laws of the State of <br />Minnesota. <br />1 <br />
