Hugo City Council Meeting Minutes for May 16, 2016 Page 4 of 8 Approve the Stormwater Reuse Agreement for Clearwater Cove As part of the Clearwater Cove development, the developer was installing a storm-water reuse system to irrigate the residential lots, public park, and landscaping along Oneka Parkway. They will also using the reuse system to meet the required infiltration requirements for the development. Adoption of the Consent Agenda approved the stormwater reuse agreement for the Clearwater Cove Development. Approve Resolution Cancelling Tax Increment Development Agreement with Schwieters Properties,LLP The City had received a request from Schwieters Properties to cancel the tax increment financing development agreement for Lot 2, Block 1, Schwieters Millwork Subdivision (13 825 Fenway Boulevard). This agreement required them to build a 45,000 sq. ft. building on the property and agree to a 15-year minimum assessed value in exchange for purchasing the property from the City for no money down. To the best of the City's knowledge, they have performed all of the requirements contained in the development agreement and have repaid the business subsidy granted by the City. Adoption of the Consent Agenda approved RESOLUTION 2016-11 CANCELLING TIF DEVELOPMENT AGREEMENT. Approval of Lawful Gambling Exempt Permit for Devo Benefit on Sunday,July 17, 2016 at the American Legion I The Hugo American Legion Auxiliary Post 620 had requested a lawful gambling exempt permit to conduct raffles during the benefit for Angela Deyo on July 17, 2016 at the Hugo Legion. Angela was diagnosed with cancer in March 2015, and a benefit is being held to raise money to assist in paying medical bills. Angela lives in Lino Lakes with her husband and three kids. Adoption of the Consent Agenda approved the lawful gambling exempt permit for the Deyo benefit on July 17, 2016. Vacation of Drainage and Utility Easement—Clearwater Cove Outlot G D.R. Horton requested a vacation of the existing drainage and utility easement located over Outlot G, Clearwater Cove. Planner Rachel Juba explained where the property was located, stating the outlot will be used for the development of Clearwater Cove 2nd Addition. New drainage and utility easements will be placed on the lots at the time the final plat is recorded. She stated that staff is comfortable with the applicant's requests to vacate the drainage and utility easements. Mayor Weidt opened the public hearing. After hearing no comments,he closed the public hearing. Klein made motion, Miron seconded, to approve the notice to vacate the drainage and utility easement located over Outlot G, Clearwater Cove. All Ayes. Motion carried.
