BACKGROUND: <br />In July 2004, the City Council approved a PUD amendment and preliminary plat to be known as <br />Victor Gardens South Village. The final plat was later approved by the Council in September <br />2004. The PUD standards are the same as the PUD standards approved as part of the original <br />Victor Gardens PUD. The approved plat includes 4 commercial lots and 14 townhomes. <br />However, no approvals were granted for the commercial lots. This lot was shown as a bank <br />building on all previous plans. Therefore, the applicant must request approval of a PUD <br />Amendment and Site Plan for the development of a dentist office building on Lot 2, Block 2, <br />Victor Gardens South Village, the last commercial lot in the development. <br />4. ANALYSIS: <br />A. Level of City Discretion in Decision -Making <br />The City has a relatively high Ievel of discretion in approving PUD Amendment. A PUD must <br />be consistent with the City's Comprehensive PIan. The City may impose reasonable <br />requirements in a PUD not otherwise required if the City deems it necessary to promote the <br />general health, safety and welfare of the community and surrounding area. <br />The City's discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br />B. Consistency with Ordinance Standards <br />The Victor Gardens PUD is a compact, mixed-use development consisting of residential, retail, <br />office, and institutional uses. The proposed planning and design approach is commonly referred <br />to as Traditional Neighborhood Development (TND). in short, the design concept includes 1) <br />neighborhoods defined by public spaces, 2) a range of housing types, 3) street designs and <br />pedestrian walkways that keep cars in perspective, 4) architecture that responds to its <br />surrounding and local traditions, and 5) a mix of land uses to meet the daily needs of residents. <br />Proposed Development <br />The proposed dentist office building will be located in the middle of the site, along the public <br />street with the main entrance to the building facing the parking lot to the east. The building <br />layout is consistent with the principles of TND to create a pedestrian -friendly and attractive <br />streetscape by bringing buildings up to the street edge and providing buffers between the parking <br />areas and the street. <br />
