Backer Minor Subdivision & CUP <br />Utilities <br />The property is currently outside of the Metropolitan Urban Service Area (MUSA), which means <br />services are not currently available to the site or planned for the site in the near future. The <br />Agricultural (AG) zoning district is an area identified as requiring installation of private well and <br />septic systems until urban services are available. <br />The proposed undeveloped parcels will have new well and septic systems. The applicant has <br />submitted soil tests indicating that there is sufficient space on the parcels that are suitable for a <br />septic system as well as an alternative septic location. The locations have been reviewed and <br />approved by Washington County. <br />Grading <br />A grading plan will have to be submitted to the City prior to the issuance of a building permit for <br />the proposed vacant parcels. The applicant shall demonstrate that the building site will comply <br />with the City's regulations regarding building elevation related to groundwater and floodplain. <br />The applicant is showing the lowest floor elevation, on the survey, and it will be verified at the <br />issuance of a building permit. <br />Streets and Access <br />The proposed parcels have access to 140'h Street North. There is an existing driveway to the <br />proposed 20 acre parcel. The proposed new driveways to access the 14.18 acre parcel and 18.20 <br />acre parcel will be reviewed and approved with each building permit. <br />The applicant is showing the required 33 -foot wide roadway easement along the south boundary <br />of the property. This easement will be required to be dedicated prior to the recording of the <br />subdivision. <br />CUP Request <br />An existing 20 acre parcel to the north of the sites contains a single family home and has an <br />existing driveway, which will meander through three parcels before connecting to the property. <br />A CUP is required for a driveway if it is shared by two or more separate parcels or lots of land. <br />Staff used these standards to review the application and found that the request meets all <br />applicable standards as follows: <br />1. The proposed use is permissible by law. <br />The proposed use is allowed by conditional use permit. <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br />
