Backer Minor Subdivision & CUP <br />3. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The properties are currently zoned Agricultural (AG). The approximately 30 acre parcel contains <br />a single family home and accessory buildings while the 20 acre parcel is undeveloped. The <br />properties contain many wetlands and some floodplain. The surrounding properties are also <br />zoned Agricultural (AG) and are large lots occupied by single family homes. <br />B. Natural Characteristics of Site <br />The properties have varying topography with wetlands covering the majority of the area. The <br />applicant has been in contact with the Browns Creek Watershed District and is showing the <br />required setbacks from wetlands on the sites. The applicant is currently working on proper <br />easement areas as required by the Browns Creek Watershed District and it is a condition of <br />approval that they are verified and recorded. <br />4. LEVEL OF DISCRETION IN DECISION-MAKING: <br />The City has limited discretion in approving or denying minor subdivision applications. The <br />City's discretion is limited to whether or not the proposed minor subdivision meets the standards <br />outlined in the Zoning Ordinance. If it meets these standards, the City must approve the <br />subdivision. <br />The City's discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets <br />these standards, the City must approve the conditional use permit. <br />5. ANALYSIS: <br />A. Consistency with Ordinance Standards <br />Minor Subdivision and CUP <br />Lot Size <br />The Agricultural (AG) zoning district requires a minimum lot size of 10 acres with a 300 foot <br />minimum width and a minimum depth of 480 feet. The applicant is requesting to subdivide an <br />approximately 30 acre parcel and 20 acre parcel to create a 14.48 acre parcel, a 20 acre parcel, <br />and an 18.20 acre parcel. <br />The proposed lots will meet the requirements with the 14.48 acre parcel having a 475 foot width <br />and lot depth of 1,328 feet, the 20 acre parcel having a 656 foot width and lot depth of 1,295 feet, <br />and the 18.20 acre parcel having a 459 foot width and a 1,295 foot depth. <br />
