Attachment for City of Hugo Notice of Decision for Adelaide Landing Special Considerations, Wetland <br />Replacement, Sequencing Flexibility, and No -loss as well as Notice of Decision Conditions <br />April 13, 2017 <br />Special Considerations <br />The applicant has addressed MN Rule 8420.0515 which requires the applicant to consider a variety of <br />factors that may be negatively affected by wetland impacts. The applicant provides a discussion of <br />these considerations in the attached memorandum titled "Adelaide Landing Wetland Replacement plan <br />Application Response to Comments" dated April 11, 2017. <br />Sequencing Flexibility <br />The applicant is requesting sequencing flexibility for MN Rule 8420.0520 Subp 1.A., since a second <br />alternative that avoids all wetland impacts is not feasible based on the city requirement to extend 137th <br />Street east, then south through the entire site which results in impacts 1-6. Flexibility is necessary for <br />impact 7 (based on MN Rule 8420.0520 Subp 1.A and B) since this impact has not been avoided or <br />minimized. <br />The basis for request for sequencing flexibility is found in MN Rule 8420.0520 Subp. 7a.A.(1) and (2). <br />The applicant demonstrates that the impacted wetlands have been degraded to the point where <br />replacement of the impacts by wetland bank credits would result in a gain and function and public value. <br />This was demonstrated through MnRAM assessment that documents the low value for wetland 2, as <br />well as the wetland delineation vegetation datasheet which documents no vegetation or high density <br />reed canary grass (invasive). The applicant also demonstrates that avoidance of wetland 3 would result <br />in severe degradation of the wetland's ability to function and provide public value due to the <br />surrounding land use. <br />Replacement <br />After avoidance and minimization, the Adelaide Landing Development Project will result in 1.32 acres or <br />57,582 sq. ft. of impacts to type % wetlands. <br />The applicant is proposing to replace wetland impacts via existing wetland bank credits. The credits are <br />in kind and in the same bank service area, therefore reducing the replacement ratio from 2.5:1 o 2:1 or <br />a total of 2.64 credits (acres). A purchase agreement has been signed by both the seller and the buyer <br />for wetland bank credit purchase from wetland bank account # 1542 located in Stearns County, Bank <br />Service Area 7. <br />Nn -Inns <br />The applicant is requesting a no -loss for the installation of a boardwalk trail that crosses wetland 2 as <br />shown in Exhibit 4b of the application dated February 17, 2017. The applicant proposes that the <br />boardwalk will not alter the cross section or hydrological characteristics, obstruct flow patterns, change <br />
