may change or impede the flow of water through any natural, designed, improved or graded <br />drainage area. <br />7.12 Additional Protective Covenants. Master Developer may require the imposition <br />on a Neighborhood or portion of a Neighborhood, in connection with the creation or <br />development of the Neighborhood or the annexation of any Additional Property, additional <br />protective covenants and use restrictions not inconsistent with those contained in this Master <br />Declaration. <br />7.13 Time Shares Prohibited. The time share form of ownership, or any comparable <br />form of lease, occupancy rights or ownership which has the effect of dividing the ownership or <br />occupancy of a Unit into separate time periods or ownership intervals, is prohibited. <br />7.14 Quiet Enjoyment; Interference Prohibited. All Owners and Occupants and their <br />invitees shall have a right of quiet enjoyment in their respective Units subject to the normal and <br />customary sights, sounds, odors and activity generated by the use of the Property by other <br />Owners and Occupants. No Person shall engage in activity which damages the Property, causes <br />a nuisance or unduly restricts or interferes with the use and quiet enjoyment of the Property by <br />other Owners and Occupants. <br />7.15 Community Irrigation System. The use of the community irrigation system shall <br />be subject to such Master Rules as the Master Board shall establish from time to time. <br />7.16 Compliance with Law. No use shall be made of the Property which would violate <br />federal, state or local laws, regulations or ordinances, nor shall any act or use be permitted which <br />could cause waste to the Property, cause a material increase in insurance rates on the Property, or <br />otherwise cause any unusual liability, health or safety risk, or expense, for the Master <br />Association, the Members or any Owner or Occupant. <br />SECTION 8 <br />ARCHITECTURAL AND LANDSCAPE STANDARDS <br />8.1 General. It is the intent of the Master Developer to create a general plan and <br />uniform scheme of development of the Property and to create within the Property a residential <br />community of high quality and harmonious Improvements. Accordingly, all site work, <br />landscaping, structures and other Improvements visible from outside of existing structures are <br />subject to standards for design, landscaping, architecture and aesthetics adopted pursuant to this <br />Section (the "Design Guidelines") and the approval procedures set forth in this Section, except as <br />this Section or the Design Guidelines may otherwise specify. <br />8.2 Design Review Authority. The authority to review and act upon all applications <br />for review of proposed Improvements is granted to the Master Developer until delegated, expired <br />or terminated as provided in this Section, at which time the authority shall, subject to the <br />qualifications and limitations herein, transfer to a Design Review Committee appointed by the <br />Master Board. The entity, whether the Master Developer, the Design Review Committee, or <br />other approved designee, having jurisdiction in a particular review case is sometimes herein <br />referred to as the "Design Reviewer." <br />21 <br />2190398.v1 <br />
