CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />RESOLUTION 2017-20 <br />APPROVING A FINAL PLAT AND DEVLEOPMENT AGREEMENT FOR D.R. <br />HORTON, INC. — MINNESOTA FOR CLEARWATER COVE 4th ADDITION <br />WHEREAS, D.R. Horton, Inc. — Minnesota, has requested approval of a final plat for the <br />property legally described as follows: <br />Outlot A, Clearwater Cove 3rd <br />WHEREAS, the Planning Commission has reviewed the preliminary plat and PUD at a duly <br />called public hearing and recommended approval of the preliminary plat and PUD; and <br />WHEREAS, the City Council approved the preliminary plat and PUD at its meeting on August <br />3, 2015. <br />NOW, THEREFORE, BE IT HEREBY RESOVLED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by D.R. Horton, <br />Inc. — Minnesota, for a final plat, subject to the following conditions: <br />1. The final plat is approved to allow the creation of 20 single family lots, in accordance <br />with the plans and application received by the City on May 19, 2017, except as amended <br />by this resolution. <br />2. The development shall substantially comply with all plans and conditions of the PUD and <br />preliminary plat approval granted by the City on August 3, 2015. <br />3. Development standards shall comply with Resolution 2015-38 and 2015-39, as amended. <br />4. The developer shall comply with all conditions outlined in the City Engineer's memo <br />dated July 16, 2015, August 12, 2015, and June 15, 2017, and revisions required in <br />"redlined" comments from the City Engineer. <br />5. The developer shall design and install a stormwater re -use system for irrigation of the <br />individual lots. <br />6. The developer shall establish a property owners association for the development to <br />own/operate/maintain common elements, landscaping, and the water re -use system. <br />7. The 8 foot wide bituminous public trail connection from Victor Gardens as shown in the <br />plans shall be installed, prior to the release of the letter of credit for the development. The <br />trail shall end at the cul-de-sac connection on 142nd Circle North. An escrow shall be <br />established with the City to extend the trail to the south plat boundary at the time deemed <br />necessary by the City. <br />
