CITY OF <br /> RESOLUTION NO. <br /> RESOLUTION IN SUPPORT OF MUNICIPAL EMINENT DOMAIN AUTHORITY <br /> Whereas, the Twin Cities Metropolitan area has long been recognized as one of the most <br /> livable metro areas in the nation because of its strong urban core, livable neighborhoods <br /> and access to cultural activities; <br /> Whereas,the Kelo vs. New London, Connecticut Supreme Court decision has been used <br /> to fuel anti-eminent domain activity nationally and in Minnesota; <br /> Whereas, the Kelo ruling had no effect on Minnesota eminent domain statutes and did not <br /> in any way expand municipal eminent domain authority in Minnesota; <br /> Whereas,the state of Minnesota has granted local decision making authority to cities; <br /> Whereas, Minnesota cities have used eminent domain sparingly and judiciously <br /> throughout the state; <br /> Whereas, Metro area cities have used eminent domain for redevelopment and <br /> revitalization efforts; <br /> Whereas, redevelopment and revitalization are critical to the livability and long-term <br /> economic viability of the Metro area and the protection and enhancement of private <br /> investments in homes and businesses; <br /> Whereas, many municipal eminent domain actions are non-controversial and initiated in <br /> order to arrive at an agreeable purchase price or to provide the seller with a federal tax <br /> break; <br /> Whereas, the Johnson-Bakk eminent domain bill severely restricts the use of eminent <br /> domain for redevelopment and revitalization efforts,threatens opportunities to reinvest in <br /> our urban centers, and increases taxpayer costs. <br /> Now, Therefore, Be it Resolved that the City Council of the City of strongly <br /> opposes the Johnson-Bakk eminent domain bill as unduly restrictive.
