LEVEL OF DISCRETION IN DECISION-MAKING <br /> The City's discretion in approving or denying a site plan is limited to whether or not the <br /> proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br /> it meets these standards, the City must then approve the site plan. <br /> 3. CONTEXT: 4* <br /> A. Surrounding Land Use and Zoning <br /> The properties to the north, south, and east of the site consist of warehousing and light <br /> manufacturing industrial uses, are zoned general industrial, and are within the Bald Eagle <br /> Industrial Park. The properties to the west consist of attached townhomes and are zoned as a <br /> planned unit development (PUD). The City's Comprehensive Land Use Guide Plan designates <br /> the Bald Eagle Industrial park area for commercial/industrial uses. <br /> B. Natural Characteristics of Site <br /> The subject property is relatively flat, contains mainly upland areas, and natural vegetation. <br /> There are no structures on the property. <br /> 4. ANALYSIS: <br /> The application complies with the ordinance standards as follows: <br /> Building Setbacks <br /> The City's Comprehensive Land Use regulations require 30-foot front and rear yard setbacks and <br /> 40-foot side yard setbacks. As proposed, the building complies with all applicable setback <br /> requirements. <br /> Parking <br /> The Comprehensive Land Use Regulations provide specific parking standards based on the use <br /> of the building. Since the proposed building contains both warehouse and office uses separate <br /> formulas should be used to calculate the total required amount of parking spaces required for <br /> each use. Based on the proposed 35,400 square feet of warehouse space and the 9,600 square <br /> feet of office space, the ordinance requires 75 parking spaces for customers and employees. The <br /> proposed site plan identifies the construction of 48 parking spaces with 27 additional parking <br /> spaces identified as "proof of parking." Staff considers the proposed amount of parking spaces <br /> adequate for the operation of the current occupants. Pearson Mechanical Inc. does not intend on <br /> maximizing the entire building immediately and much of the office space indicated on the floor <br /> plan is reserved for future growth. The additional 27 spaces may be needed at a later date if <br /> Pearson Mechanical expands its operations or if building is occupied by another business. The <br /> 2 <br />
