Schwieters Final Plat, Text Amendment, Site Plan and CUP's <br />Page 8 <br />because of the sewer elevation and the existing storm sewer creates a conflict. There is another <br />service to the north in a different sewer district. The site can connect the sewer district by <br />connecting a sewer pipe to the existing lift station along 140th Street. The lift station is <br />adequately sized; however the pumps will be required to be upsized to maintain capacity for the <br />remaining areas in the sewer district. The applicant will be responsible for the upsizing of the lift <br />station pumps in the amount of $15,000. This is a cost-effective solution as the applicant would <br />otherwise need to install their own lift station on site. The sanitary sewer that extends south from <br />140th Street along the west side of Fenway Avenue will be in a 45-foot public drainage and <br />utility easement. The main will be publicly owned and maintained by the City of Hugo. <br />Individual services extended from this main will be the responsibility of the owner. Applicable <br />trunk, City connection, and Met Council connection fees will apply. <br />Wetlands <br />There are two existing wetland basins located in the center of the site. There are also wetlands <br />throughout the wooded area to the west. The Technical Evaluation Panel (TEP) approved <br />wetland delineation for the property. The applicant is proposed to impact the wetlands in the <br />center of the site. The applicant has a wetland replacement plan approved by the TEP for the <br />impacts. The applicant is proposing to purchase wetland banking credits for the impacts to the <br />wetlands. <br />The applicant will need to apply for a "no -loss" determination to the temporary impacts to the <br />wetland in the northwest portion of the site for construction of the proposed stromwater <br />management area. <br />Park Dedication <br />Park Dedication is not required for commercial and industrial developments. <br />Clearwater Creek Preserve park is adjacent to this parcel on the west side. Staff has discussed <br />with the applicant possible donation of a portion of the property to be connected to the existing <br />park. <br />D. Conditional Use Permits <br />Exterior Storage <br />The applicant is proposing outdoor storage area. The Business Park (BP) zoning district allows <br />exterior storage with an approved conditional use permit. <br />The City Council must review the application for a conditional use permit with the standards <br />listed in Section 90-37 of the City Code. Staff used these standards to review the application and <br />found that the request meets the applicable standards as follows: <br />(1) The proposed use is permissible by law. <br />The use is permissible by law. <br />
