Page 2 <br />TGK Automotive Rezoning and Site Plan <br />The City has received an application from two property owners to rezone five parcels from <br />Neighborhood Service (NS) to General Commercial (C-2). Premier Bank owns four parcels and <br />TGK Automotive has a contract on one parcel. The parcel under contract with TGK Automotive <br />is also requesting site plan approval for the auto repair business. The rezoning, if approved, <br />would allow for all permitted uses in the C-2 district. This request is not specific to the proposed <br />use. <br />3. BACKGROUND: <br />In February 2018, TGK Automotive presented a sketch plan to the Economic Development <br />Authority (EDA), Planning Commission, and City Council for the auto repair business. They <br />asked for comments on the site layout, architecture, and rezoning of the property. <br />The Commissions and City Council were generally comfortable with the rezoning of the property <br />to General Business (C-2), but stated the transition and buffer to the residential properties to the <br />east is important and that the following items should be incorporated into the site plan: <br />• The number of cars parked/stored outdoors should be limited and screened from the <br />residential properties to the east and Highway 61. <br />• The architecture is important as it's on Highway 61. The building should be built out of <br />quality materials. <br />• Any roof top or ground mechanical equipment should be screened from view. The roof <br />top mechanical equipment should be screened with the extension of the parapet walls of <br />the building. <br />• The lighting should be directed away from the residential properties to the east. <br />• The transitions between the land uses should include ideas on how to abate noise. For <br />example, the overhead doors should remain closed as work is being completed on the <br />vehicles. <br />They agreed that the rezoning seemed reasonable, however the site plan will be essential in <br />making that decision. <br />At that time staff was comfortable with the request, as long as there are proper transitions <br />between the land uses and the impact on the surrounding residential properties is minimized. <br />Staff stated that if the rezoning of the property is supported, then it may be reasonable to expect <br />other property owners to the north and south of this site to request the same zoning. Staff was <br />also comfortable with these properties also being rezoned to C-2 as well. <br />4. LEVEL OF DISCRETION IN DECISION-MAKING <br />The City has discretion in approving or denying rezoning applications, based on whether or not <br />the proposal meets the standards outlined in the Comprehensive Plan and Zoning Ordinance <br />requirements. If the City finds that all the applicable standards are met, the rezoning application <br />must be approved. However, if the City finds that any of the applicable standards are not met, <br />the application may be denied. <br />2 <br />
