Page 3 <br />TGK Automotive Rezoning and Site Plan <br />The City's discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br />5. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The subject property is zoned Neighborhood Service (NS) and the land use is identified as <br />Commercial (COM). The property to the north is zoned General Business (C-2) and is occupied <br />by an outdoor equipment sales and repair business. The property to the south is zoned <br />Neighborhood Service (NS) and is occupied by a residential home. The properties to the east are <br />zoned Low Density Multiple Family Residential (R-4) and are occupied by the Pineview <br />Meadows Development. The property to the west, across Highway 61, is zoned General <br />Industrial (I-3) and is occupied by industrial uses. <br />B. Natural Characteristics of Site <br />The site is currently vacant. There were other older buildings including a restaurant, two hotel <br />buildings, and a house on site that have been removed. There is a wetland on the northeast <br />portion of the site. There are also trees on the east and south portion of the site. The applicants <br />site plan shows some of those trees being preserved. <br />6. ANALYSIS: <br />A. Rezoning <br />Staff has analyzed this rezoning based on the four criteria in the City ordinance under Section 90- <br />40, Zoning Amendments: <br />1. The requested amendment is in compliance with the City's Comprehensive Plan <br />The City's Comprehensive Plan identifies the subject parcels as Commercial. The <br />Comprehensive Plan identifies three types of commercial land uses that are reflected in the <br />zoning regulations. The regulations specifically list three types of commercial zoning as; <br />Neighborhood Service (NS), Central Business (C-1), and General Business (C-2.) <br />The purpose of the Neighborhood Service (NS) zoning district is to provide a location for <br />commercial and service businesses to conveniently serve the needs of an identified residential <br />neighborhood. The NS District provides for those neighborhood commercial uses, but it does not <br />allow for restaurants, auto sales, or other uses intended primarily to draw traffic from outside the <br />neighborhood. The NS district does allow for neighborhood food service, different from <br />restaurants, which has several regulations in regards to hours of operation and outdoor noise. <br />3 <br />
