RESOLUTION 2018 - 37 <br />APPROVING PLANNED UNIT DEVELOPMENT FOR SHLAYBA, INC. <br />FOR "THE PRESERVE ON SUNSET LAKE" ON PROPERTY LOCATED SOUTH OF 125TH <br />STREET NORTH, EAST OF ILLIES AVENUE NORTH AND NORTH OF 120TH STREET <br />WHEREAS, Shlayba, Inc. has requested approval of a Planned Unit Development to allow <br />construction of 13 single family lots and 3 outlots on the 136.7 -acre property legally described <br />as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called <br />Public Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />HUGO, MINNESOTA, that it should and hereby does approve the request by Shlayba, Inc. for a <br />PUD general plan, subject to the following conditions: <br />1. A PUD general plan/site plan is approved to allow development of 13 single family home lots <br />and 3 outlots, in accordance with the application and plans received by the City on August <br />20, 2018 and revisions received on September 5, 2018, September 6, 2018, October 8, <br />2018, October 12, 2018, and October 18, 2018 except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested final plat. <br />3. Development standards for the PUD shall be as follows: <br />Minimum lot size <br />5 acres <br />Minimum lot width <br />Minimum front yard building setback <br />164 feet <br />75 feet <br />Minimum side yard building setback <br />25 feet <br />50 feet <br />Minimum rear yard building setback <br />Maximum building height <br />25 feet <br />Maximum lot area to be covered by <br />buildings <br />30% <br />Maximum lot area to be covered by <br />impervious surface <br />25% <br />4. Outlot A shall be owned and maintained by the HOA. No development is allowed in the <br />outlot except the private trail/boardwalk that is shown on the plans. These improvements <br />shall be the responsibility of the HOA. <br />5. Park Dedication shall be a combination of land and cash -in -lieu of land. <br />
