(Above Space Reserved for Recording Data) <br /> MASTER DECLARATION <br /> ADELAIDE LANDING <br /> This Master Declaration of Adelaide Landing (the "Master Declaration"), is made and <br /> executed this day of , 2017, by OP5 Adelaide, LLC, a Minnesota limited <br /> liability company (the "Master Developer"), pursuant to Section 515B.2-121 of the Minnesota <br /> Common Interest Ownership Act ("MCIOA"). <br /> WITNESSETH <br /> WHEREAS, the Master Developer, as the owner or with consent of the owner(s) <br /> attached hereto, desires to submit certain real property located in the County of Washington, <br /> State of Minnesota, and legally described in Exhibit A attached hereto (the "Property") to this <br /> Master Declaration; <br /> WHEREAS, the Master Developer also owns, or may acquire, and has the authority add <br /> to the Property, all or part of the real property legally described in Exhibit C attached hereto (the <br /> "Additional Property"); <br /> WHEREAS, the Master Developer has established the Master Association, as defined in <br /> this Master Declaration, to act as a "master association" within the meaning of MCIOA, for the <br /> purposes described in this Master Declaration; <br /> WHEREAS, the Property and any Additional Property subjected to this Master <br /> Declaration shall not, collectively, constitute a separate common interest community as defined <br /> in MCIOA; and <br /> WHEREAS, the Master Developer desires to provide for the administration of certain <br /> services for the Property; the enforcement of the covenants, conditions and restrictions contained <br /> in this Master Declaration; and the preservation of the amenities and architectural character of <br /> the Property; and to this end wishes to subject the Property to this Master Declaration. <br /> NOW, THEREFORE, the Master Developer, with the consents of the owners of those <br /> parts of the Property not owned by the Master Developer, subjects the Property to this Master <br /> Declaration pursuant to Section 515B.2-121 of MCIOA, declaring (i) that this Master <br /> 219o39s.v1 <br />
