Declaration shall constitute covenants to run with the Property, and(ii) that the Property, and any <br /> Additional Property added thereto, shall be owned, encumbered, used, operated, occupied and <br /> conveyed subject to the covenants, conditions, restrictions, easements, charges and liens <br /> described in this Master Declaration, all of which shall be binding upon all Persons, as defined in <br /> this Master Declaration, having or acquiring any right, title or interest therein, and their heirs, <br /> personal representatives, successors and assigns. <br /> SECTION 1 <br /> DEFINITIONS <br /> The following terms, as used in this Master Declaration, shall have the following <br /> meanings: <br /> 1.1 "Additional Property" means the real property described in Exhibit C attached <br /> hereto, and all Improvements located thereon, now or in the future, which Additional Property <br /> the Master Developer has the unilateral right to add to the Property. <br /> 1.2 "Builder" means a Person who acquires a Unit from the Master Developer or <br /> another Person for the construction and sale of a Dwelling located or to be located thereon. <br /> 1.3 `Building" means each structure which is or becomes a part of the Property and <br /> contains a Dwelling or Dwellings. <br /> 1.4 "City"means the City of Hugo, Minnesota. <br /> 1.5 "Design Guidelines" means the Design Guidelines for Adelaide Landing <br /> described in Section 8. <br /> 1.6 "Design Review Committee" means the committee of the Master Association that <br /> makes determinations concerning design and architectural standards for the Property as provided <br /> in Section 8.2.2. <br /> 1.7 "Dwelling" means all or part of a Building consisting of one or more floors, <br /> which is intended for separate ownership as a single-family residence, and constituting or located <br /> within a Unit. A Dwelling may be (i) a detached single-family residential structure, or(ii) one of <br /> multiple residences within a Building. <br /> 1.8 "Improvement" means any physical improvement of any kind, including without <br /> limitation any Building, wall, fence, retaining wall, sign, enclosure, screening, utilities system, <br /> communications system, irrigation or drainage system, pond, roadway, trail, planting, <br /> landscaping, or any other type of structure or physical improvement, and any additions or <br /> changes thereto, located on the Property. <br /> 1.9 "Master Assessments" means, collectively, all assessments levied (i) by operation <br /> of the Master Governing Documents, or(ii)by the Master Association pursuant to Section 6. <br /> 1.10 "Master Association" means Adelaide Landing Master Association, a nonprofit <br /> corporation created pursuant to, the Minnesota Nonprofit Corporation Act, Minnesota Statutes <br /> 2 <br /> 219o39s.v1 <br />
