RESOLUTION NO. <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION AUTHORIZING NEGOTIATIONS AND/OR EMINENT DOMAIN TO AQUIRE THE PROPERTY <br />AREAS NEEDED FOR THE 130TH STEET IMPROVEMENT PROJECT <br />WHEREAS, The City of Hugo has initiated the 130T" Street Improvement Project (the Project), including <br />reconstruction of 130th Street; a roundabout at the intersection of 130th Street and Flay Avenue; realignment of <br />the intersection at 130th Street and Goodview Avenue; street and utility construction; new pedestrian facilities; <br />and <br />WHEREAS, the construction schedule for the Project contemplates that the Project will be completed during the <br />2019 construction season; and <br />WHEREAS, it is necessary that the City obtain title and possession of the areas identified in Exhibit A for the parcels <br />as shown below: <br />$ 6,650.00 - Parcel 1— David and Julie Johnson — PID #32.031.21.22.0022 <br />$ 8,850.00 — Parcel 2 — Beaver Ponds — PID #32.031.21.21.0003 <br />$17,100.00 — Parcel 3 — Kevin Peltier — PID #29.031.21.44.0001 <br />by negotiation and/or eminent domain for the necessary easements to allow for the construction of the project; <br />and <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY HUGO, MINNESOTA: acquisition is hereby <br />authorized as follows: <br />1. Offers are made for the necessary easements for the parcels identified in Exhibit A, pursuant to <br />Minnesota Statute. <br />2. If negotiation doesn't result in the in the prompt acquisition of the easements, staff is authorized and <br />directed without further action from the City Council to proceed with eminent domain pursuant to MN <br />State Statute while continuing to work towards a negotiated settlement. <br />This resolution was adopted by the City Council of the City of Hugo on the 17th day of December, 2018, by a vote of <br />Ayes and Nays <br />Tom Weidt, Mayor <br />ATTEST: <br />Michele Lindau, City Clerk <br />
