The Preserve on Sunset Lake <br />Page 6 <br />of this 27-acre private open space amenity and the trail loop is one of the benefits of the <br />PUD. <br />The City Parks Plan shows a future trail along 12511 Street and staff recommends that a <br />10-foot trail easement be dedicated on the south side of the street. This would be in the <br />same location as the 10-foot drainage and utility easement and would allow an <br />opportunity for a future trail behind the ditch. <br />Park Dedication and Open Space <br />The City currently owns a 0.7-acre park parcel that is wooded with a slope to the Sunset <br />Lake shoreline. Outlot B (0.93 acres) is proposed to be dedicated to the City for park <br />purposes to expand the existing park property along Sunset Lake. There are currently no <br />plans to make park improvements to the property. It has not been a priority for the Parks, <br />Recreation and Open Space Commission with their annual goal setting or capital <br />improvement planning. <br />The park dedication section of the City Code requires the applicant dedicate 10% of the <br />developable acres for park land with a density of up to 3.99 units per acre. The current <br />park dedication fee is $2,400 per unit. The developer is required to dedicate 11.4 acres <br />or pay a fee of $31,200. <br />The developer is proposing to dedicate Outlot B totaling 0.93 acres. Staff finds that this <br />satisfies 8% of the requirement and therefore the remaining requirement would normally <br />be satisfied by paying a fee which would be $28,704. The applicant is requesting that the <br />park dedication fee be waived due to the high cost of the lake front property and <br />provided some information from an appraiser about the valuation on October 17th. <br />Staff did not have adequate time to review the information before the Parks, Recreation <br />and Open Space Commission meeting. The Commission considered this and <br />recommended that the City accept Outlot B to satisfy a portion of the park dedication <br />requirements for this PUD and take the remaining park dedication in cash. The <br />Commission recommended that the City Council consider the land valuation based on <br />an appraisal report from a source acceptable to both the City and the applicant. The <br />Commission recommended that staff and the developer work to gather this information <br />prior to the City Council meeting. <br />C. Conclusions <br />Staff has reviewed the PUD general plan and preliminary plat for consistency with the <br />applicable standards outlined in the Comprehensive Land Use Regulations and the <br />applicable PUD standards and finds that the applications are generally consistent with <br />the standards with the conditions of approval as recommended in the attached <br />resolutions. <br />5. RECOMMENDATION: <br />Staff recommends approval of the rezoning, PUD and preliminary for Shlayba, Inc., <br />subject to the conditions listed in the attached resolutions. <br />
