Resolution 2018- <br /> Page 2 <br /> 4. Outlot A shall be owned and maintained by the HOA. No development is allowed in the outlot <br /> except the private trail/boardwalk that is shown on the plans. These improvements shall be <br /> the responsibility of the HOA. <br /> 5. The Covenants shall be revised to: <br /> a. Reference Outlot C in paragraph 3, page 1. <br /> b. State that the Outlot A and C are unbuildable. <br /> c. Note that no structures are allowed on Outlot C and that it can only be sold with Lot 4. <br /> 6. Park Dedication shall be a combination of land and cash-in-lieu of land. <br /> a. Outlot B shall be deeded to the City. The 0.93-acre park satisfies a portion of the park <br /> dedication requirement. <br /> b. The remaining required park dedication shall be cash in lieu of land in the amount of <br /> determined by the City Council based on an appraisal and valuation from a firm agreed <br /> upon by the City and the applicant. <br /> c. A 10-foot trail easement shall be provided on the south side of 125th Street North. The <br /> trail easement in recordable form shall be prepared and submitted for review and approval <br /> by the City. <br /> 7. PUD flexibility is permitted to allow: <br /> a. Allow lot sizes less than 10 acres. <br /> b. Allow lot widths less than 300 feet. <br /> 8. A complete set of revised plans addressing the conditions of approval shall be submitted for <br /> city approval. <br /> 9. The applicant must comply the conditions from Washington County Public Works letter dated <br /> October 18, 2018. <br /> 10. The following documents must be submitted reviewed and approved by the City Attorney. <br /> Upon City approval, the applicant shall file these documents at Washington County: <br /> a. Declaration of Restrictive Covenants The Preserve on Sunset Lake. <br /> b. Trail Easement Document in Recordable form. <br /> c. Deed from the landowner to the City of Hugo for Outlot B. <br /> 11. Prior to issuance of building permits, the applicant must comply with the following conditions: <br /> a. Each permit must include written approval from development's Architectural Review Board <br /> for the proposed home showing compliance with the Architectural Design Guidelines. <br /> b. The applicant shall comply with all conditions from the City Engineer's memo dated <br /> October 18, 2018. <br /> c. Septic permits must be obtained from Washington County and a copy provided to the City. <br /> d. Well permits must be obtained and a copy provided to the City. <br /> e. The applicant must provide proof that the final plat and all associated documents have <br /> been filed at Washington County. <br />
