The Preserve on Sunset Lake <br /> Page 3 <br /> 4. ANALYSIS: <br /> A. Level of City Discretion in Decision-Making <br /> The City has a relatively high level of discretion in approving or denying a rezoning <br /> application. The proposed zoning for a property must be consistent with the City's <br /> Comprehensive Plan. If the proposed zoning is not consistent with the Comprehensive <br /> Plan, the City must deny the rezoning application. The Zoning Ordinance and Map are <br /> the enforcement tools used to implement the goals and standards set in the <br /> Comprehensive Plan. <br /> The City has a relatively high level of discretion in approving PUDs. A PUD must be <br /> consistent with the City's Comprehensive Plan. The City may impose reasonable <br /> requirements in a PUD not otherwise required if the City deems it necessary to promote <br /> the general health, safety and welfare of the community and surrounding area. <br /> The City's discretion in approving or denying a preliminary plat is limited to whether or <br /> not the proposed plat meets the standards outlined in the Comprehensive Land Use <br /> Regulations. If it meets these standards, the City must approve the preliminary plat. <br /> B. Consistency with Ordinance Standards <br /> The applicant is requesting PUD flexibility from the lot size and lot width requirements in <br /> the RR district. In exchange for this flexibility, the developer is preserving open space <br /> and a high-quality wetland in a 27-acre outlot with multi-purpose trails that will be owned <br /> and maintained by the HOA and architectural standards that will result in higher quality <br /> homes than would be required by the ordinance minimum standards. <br /> PUD General Plan <br /> Building Materials/Elevations <br /> The applicant has provided architectural design guidelines to ensure quality home <br /> design with a number of similar characteristics. The guidelines encourage quality <br /> architecture with front porches and standards to reduce the impact of the garages. <br /> These increased design standards are one of the benefits of the PUD. <br /> Lot Standards <br /> The site is located in the Rural Residential zoning district and the Shoreland Overlay <br /> district. Sunset Lake is identified as a Recreational Development lake. While none of the <br /> lots are riparian, all property within 1,000 feet of the lake is in the shoreland district. The <br /> development must comply with both the RR and Shoreland District standards. The <br /> applicant is requesting flexibility from the lot standards in the RR district as noted below: <br />
