Hugo City Council Meeting Minutes for March 18, 2019 <br />Page 5 of 8 <br />authorized under state law; however, the section of Hugo City Code that references Sunday <br />Licenses specifically states that sales cannot begin prior to 10 a.m. Staff had received a request <br />from the Hugo American Legion to amend the City Code to allow sales at 8 a.m. on Sunday's. <br />Adoption of the Consent Agenda approved ORDINANCE 2019-494 AMENDING CHAPTER <br />6-ALCOHOLIC BEVERAGES TO ALLOW FOR 8 A.M. SUNDAY SALES. <br />Approve Right-of-way and Telecommunications Ordinance Amendments to Regulate <br />Small Wireless Facilities <br />A small wireless facility, also known as a small cell, is a newer technology that is a <br />complimentary piece of equipment to traditional cell towers and provides additional cellular data <br />coverage. Recently, there was an amendment to State Statute regarding the regulation of small <br />wireless facilities. The amendments have streamlined the permitting process for placement or <br />collocation of small wireless facilities on city -owned structures in public right-of-way by <br />allowing them as a permitted use in all zoning districts except historic and residential. However, <br />the law also allows cities to manage small wireless facilities through a permitting process, <br />including a collocation agreement and ordinances. Staff recommended approval of the <br />amendments to update the right-of-way and telecommunications ordinance per the new <br />amendment to State law to prepare for the eventual deployment of small wireless facilities within <br />the community. At its February 28, 2019, meeting, the Planning Commission considered and <br />held a public hearing on the ordinance amendments. The Planning Commission agreed with <br />revisions and recommended approval. Adoption of the Consent Agenda approved <br />ORDINANCE 2019-495 RELATING TO AND REGULATING PUBLIC RIGHT-OF-WAY <br />AND TELECOMMUNICATIONS. <br />Approve Assignment of Agreement for Municipal Advisor Services <br />Since 2001, Springsted, Inc., had been the City's financial advisors. On January 10, 2019, <br />Springsted announced its intention to combine with Baker Tilly Virchow Krause, LLP, a <br />financial services and accounting firm. Following the closing, the combined firm will operate its <br />public sector advisory business under the name Baker Tilly Municipal Advisors, LLC. <br />Springsted staff has been invited to join Baker Tilly. Springsted had requested the City consent <br />to the assignment of the current agreement for municipal advisor services to Baker Tilly. <br />This was a procedural matter and the transition would be seamless. Adoption of the Consent <br />Agenda approved the Consent to Assignment and authorize the City Administrator to execute the <br />document. <br />Elmcrest Avenue and East Cedar Street Joint Powers Agreement between the City of Hugo <br />and the City of Lino Lakes <br />At its January 22, 2019, Goal Setting Session, Council discussed the need to work with the City <br />of Lino Lakes on the paving of Elmcrest Avenue and East Cedar Street in Lino Lakes. Staff <br />from both Cities have been meeting to discuss the potential of a joint project to address concerns <br />raised by residents over the years regarding the condition of the gravel sections of Elmcrest <br />Avenue and East Cedar Street. Hugo Public works applies calcium chloride and grades the <br />roadways, however higher traffic volumes on these roadways resulted in deteriorated and dusty <br />roadway conditions.
