Rosemary Apartments Site Plan and CUP <br />Page 9 <br />The developer will be responsible for the City's water and sewer trunk fees, as well as the water <br />(WAC) and sewer (SAC) connection fees to be paid at the time of the building permit. The <br />developer will also be responsible for the Met Council sewer connection fee. <br />The Fire Department is requiring that another hydrant be installed on the west side of the parking <br />lot. City staff will coordinate with the developer to finalize a location. <br />Wetlands <br />Wetlands that are present on the site have been delineated by the developer and the delineation <br />has been approved by the City. The site plan includes some wetland filling, which will require a <br />wetland replacement plan. The developer submitted a complete application related to their <br />wetland replacement plan, and it is under review by the Technical Evaluation Panel (TEP). The <br />replacement plan proposes using credits from the Rosemary mitigation site. A no -loss <br />application will be approved for impacts to incidental wetlands along the northern boundary of <br />their proposed grading since these are incidental wetlands resulting from the mitigation area <br />increasing site hydrology. It is anticipated that the application approval will be on the April 15, <br />2019, City Council agenda for consideration. <br />The developer shall dedicate a drainage and utility easement to the City over the wetland. <br />Park Dedication <br />The developer is proposing to install a private small park play area for its residents on the <br />property, southwest of the building. This does not satisfy the park dedication requirement. <br />The City Code requires either park dedication of 17 percent of the buildable land area or cash -in - <br />lieu of land (currently $2,400 per unit). Cash -in -lieu of land would be $108,000 at the current <br />rates ($2400 x 45 units). The Parks Commission considered accepting cash -in -lieu of land at its <br />March 20, 2019, meeting and recommended approval to the City Council. <br />5. CONCLUSION: <br />The developer has done a good job with the overall site plan and the general design of the <br />building. Staff will continue to work with the developer on the required revisions to the plans <br />and architecture. <br />Staff finds that the proposal meets all the requirements necessary for the City to approve a site <br />plan and conditional use permit as outlined in the City Code, if the conditions are met in the <br />attached resolution. <br />6. STAFF RECOMMENDATION: <br />Staff recommends approval of the site plan and conditional use permit application subject to the <br />conditions listed in the attached resolution. <br />
