Existing Site Characteristics <br />The property is currently vacant and contains several wetlands. The upland of the property was <br />used for stockpiling of dirt, but is normally generally flat. <br />3. BACKGROUND: <br />The property is part of the Frenchman Place development that was master planned in 2008. <br />There are several lots in the development that were proposed to be a combination of institutional, <br />residential, and commercial uses. The developer at the time, indicated that this lot would be <br />developed at an apartment building. Site plan approval is required for each lot as it develops. The <br />City Council agreed with the approval of the preliminary plat that the proposed lot and building <br />layout, street alignments, and proposed uses functioned properly and fit in with the surrounding <br />areas. <br />The Medium Density Multiple Family Residential (R-5) allows for the expansion and <br />development of medium -density multiple -family uses such as townhouses and apartments where <br />public utilities are present. This district addresses the need for life cycle housing by offering an <br />alternative to single-family detached housing with a standard density between six and ten units <br />per acre and a planned unit development density of six and twelve units per acre. The project <br />meets the density requirements. <br />4. ANALYSIS: <br />A. Level of City Discretion in Decision -Making <br />The City's discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br />The City's discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the City's Comprehensive Land Use <br />Regulations. If it meets these standards, the City must approve the conditional use permit. <br />B. Consistency with Ordinance Standards <br />The applications comply with the ordinance standards as follows: <br />Conditional Use Permit <br />The developer is requesting an apartment use to be allowed on the property. Apartments are <br />allowed in the R-5 zoning district with a conditional use permit. <br />
