Resolution 2019-26 <br />Waters Edge 61 Addition Final Plat and Development Agreement <br />Setback around perimeter of the site (exterior + 25 feet <br />property lines) <br />Rear yard and setback around perimeter of the 15 feet <br />site (exterior property lines) for Lots 20 - 23 <br />5. Lot use and ownership: <br />a) Lot 38 is proposed as common space for the development that will include <br />landscaping and will be owned by the home owners association (HOA). The outlot is <br />unbuildable. <br />6. The developer shall establish a home owners association (HOA) for the development to <br />own/operate/maintain common elements, landscaping, retaining walls, private streets and <br />sidewalks, and private utilities (sanitary sewer, stormsewer, and watermain) <br />7. The landscaping planned for the plat shall be installed in one phase. The developer shall <br />take proper precautions to protect the trees as the homes are being built. <br />8. Each home shall include a minimum of 2 parking spaces within the driveway. The <br />driveway widths shall be a maximum of 24 feet at the curb <br />9. The developer shall obtain all necessary local, state, and federal permits. <br />10. Park dedication requirements were fulfilled with the first phase of this development when <br />the park land was dedicated to the City. No additional dedication is due with this phase. <br />11. Prior to recording the final plat: <br />a) The developer shall pay the sewer and water trunk fees for each lot at final plat. The <br />City's SAC and WAC fees will be paid at the time building permits issued. <br />b) HOA documents or written confirmation that the homes will be covered under the <br />HOA established for the previous phases of this development must be submitted to <br />the City Attorney for review and approval. The HOA documents shall be reviewed <br />and approved by staff prior to recording the plat. <br />c) The applicant shall provide copies of the property owners association <br />documents/covenants for City review and approval. A copy of the document shall be <br />filed for recording with the final plat. <br />d) The plans shall be revised to label all private utilities. <br />e) The developer shall enter into a development agreement, shall agree to complete all <br />improvements, and pay all fees as required by the agreement. <br />
