Hugo City Council Meeting Minutes for June 3, 2019 <br />Page 4 of 7 <br /> <br /> <br />Public Hearing on Easement Vacation for Apple Academy Located on TH61 <br /> <br />Community Development Director Rachel Juba explained that Classic Construction, Inc. was <br />requesting to vacate the 30-foot wide utility easement that runs south to north through the Apple <br />Academy site, under the location of the proposed building. The property is located on the east <br />th <br />side of TH61, south of 140 Street and TGK Auto. The existing sanitary sewer main would be <br />removed and rerouted around the proposed building. Sanitary sewer service would be extended <br />from the infrastructure located on the north side of the property with a 6-inch service extended <br />into the site. Juba recommended that Council hold the public hearing and then approve the notice <br />to vacate the drainage and utility easement. <br /> <br />Mayor Weidt opened the public hearing. There were no comments, and Weidt closed the public <br />hearing. <br /> <br />Haas made motion, Petryk seconded, to approve notice to vacate the drainage and utility easement <br />for Apple Academy. <br /> <br />All Ayes. Motion carried. <br /> <br />Public Hearing on Easement Vacation for Steve Bona for the Property Located at 12812 <br />Ethan Avenue North <br /> <br />Community Development Director Rachel Juba explained that Steve Bona had requested a <br />vacation of the existing drainage and utility easement located over a property located at 12812 <br />Ethan Avenue North. There are two parcels that were platted as part of the Woods of Bald Eagle <br />Lake development in 1998. At that time, the properties were deemed unbuildable, however, were <br />still platted as lots. The applicant had been working with City staff to combine the two parcels <br />and have a buildable lot. The lots have existing drainage and utility easements on the property that <br />were dedicated as part of the Woods of Bald Eagle Lake final plat. The areas for the easements <br />needed to be revised to be over the new floodplain areas and removed from the grading areas. <br />New drainage and utility easements would be placed on the lots at the time of the easement <br />vacation. Juba recommended Council hold the public hearing and then approve the notice to <br />vacate the drainage and utility easement. <br /> <br />Mayor Weidt opened the public hearing. <br /> <br />Kristen Larson, 12746 Ethan Avenue North, asked how they were able to refill the land without <br />having the easement vacated. She said there was substantial drainage on her property, and she <br />questioned what study had been done to determine how the vacation of this easement will impact <br />her property. <br /> <br />Juba responded that with the issuance of stormwater permits, utility easements are often vacated <br />after some grading is done to determine how the drainage will happen. Regarding drainage on <br />the resident’s property, Juba asked City Engineer Mark Ericson to explain the stormwater <br />management for that site. <br /> <br />Mark stated someone from WSB had reviewed this, and there is an analysis they look at to make <br />sure there will not be any adverse impacts to adjacent properties. He stated he would be happy to <br />meet with the property owner to discuss their property further. <br /> <br />
