RESOLUTION 2019-31 <br />APPROVING A MINOR SUBDIVISION AND VARIANCE FOR THE <br />PROPERTY GENERALLY LOCATED NORTH OF 140TH STREET NORTH <br />AND WEST OF FLAY AVENUE NORTH <br />WHEREAS, an application has been filed by Darin Moxness, 10040 140ffi Street North, <br />that requests approval of a minor subdivision and variance for a property located at 14032 <br />Flay Avenue North <br />WHEREAS, the subject property is legally described as follows: <br />LOTS 5 AND 6, BLOCK 1, TRAEGER'S ADDITION PLAT 2, WASHINGTON COUNTY, <br />MINNESOTA. <br />WHEREAS, the Planning Commission has considered said request on June 27, 2019, and <br />recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the minor <br />subdivision and variance for Darin Moxness, subject to the following conditions: <br />1. A minor subdivision is approved to allow the creation of two parcels out of one 0.63 <br />acre lot located at 14032 Flay Avenue North. <br />2. A variance is approved to allow a variance in lot sizes. The property is within the <br />Shoreland District of Egg Lake, where a minimum lot area of 15,000 square feet is <br />required. Parcel A is approved to have an area of 14,875 square feet and Parcel B is <br />approved to have an area of 12,560 square feet. <br />I. The requested variance is permissible by law. <br />II. Because of the circumstances unique to the property the applicant is <br />proposing to use the property in a reasonable manner. <br />III. The variance in lot size would not noticeably alter the character of the <br />area. <br />IV. The granting of the variance would be keeping with the spirit and intent of <br />the ordinance. <br />V. The variance will not allow any prohibited use in the district. A minor <br />subdivision that creates a residential lot is allowed in the CR-3 zoning <br />district. <br />VI. The property is located within a FEMA designated floodplain. The <br />applicant is not proposing to impact the floodplain or wetlands. <br />VII. Parcel A and Parcel B will be connected to City sewer and water. <br />
