Penton Shared Driveway CUP <br />3. LEVEL OF DISCRETION IN DECISION-MAKING: <br />The City's discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets <br />these standards, the City must approve the conditional use permit. <br />4. ANALYSIS: <br />A. Consistency with Ordinance Standards <br />The existing, vacant 18.56 acre parcel is a landlocked parcel with no established driveway or <br />access to a public road. Currently, access to the site is through a neighboring parcel to the south, <br />which has frontage on Keller Avenue North. No driveway is currently constructed on either site. <br />A CUP is required for a driveway if it is shared by two or more separate parcels or lots of land. <br />Staff used these standards to review the application and found that the request meets all <br />applicable standards as follows: <br />1. The proposed use is permissible by law. <br />The proposed use is allowed by conditional use permit. <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br />The proposed use is allowed in the AG zoning district and will keep with the spirit and intent of <br />the ordinance, which is intended to allow a shared driveway by a CUP as long as they comply <br />with the regulations. <br />3. The proposed use is compatible with the City's Comprehensive Plan and the character of the <br />surrounding area. <br />The use is existing and is compatible with the Comprehensive Plan and the addition will not alter <br />the character of the area. There are shared driveways in the area that provide access to land <br />locked parcels. <br />4. The proposed use has adequate drainage, water supply, electrical, gas, and sewage treatment <br />facilities. <br />The proposed use has adequate drainage, water supply, and utilities. A driveway permit will be <br />required and a culvert may be needed for drainage. Staff will evaluate the drainage at the time a <br />permit application is submitted. <br />5. The proposed use has adequate road access. <br />The property will have adequate road access to Keller Avenue North. <br />
