LEVEL OF DISCRETION IN DECISION-MAKING <br />The City's discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br />The City has a relatively high level of discretion in approving PUD amendments. A PUD <br />amendment must be consistent with the City's comprehensive plan. The City may impose <br />reasonable requirements in a PUD amendment not otherwise required if the City deems it <br />necessary to promote the general health, safety, and welfare of the community. <br />4. CONTEXT: <br />A. Surrounding Land Use and Zoning <br />The properties to the north, east, south, and west are all part of the Victor Gardens development, <br />are zoned PUD, and are occupied by commercial uses. The proposed site is labeled as <br />commercial in the 2030 Land Use Plan. <br />B. Natural Characteristics of Site <br />The site is currently vacant and is a corner lot that serves as an entrance to the Victor Gardens <br />development. The property is generally flat with no wetlands. <br />5. ANALYSIS: <br />A. PUD Amendment <br />The applicant is requesting approval for a PUD amendment in the Victor Gardens development. <br />Staff finds that the application is consistent with the Victor Gardens PUD general plan and meets <br />the criteria outlined in the Victor Gardens North Village 4th Addition resolutions 2007-25, 2007- <br />26, and 2007-27 approving a PUD amendment, preliminary plat, and final plat for the <br />development. <br />B. Site Plan <br />The applicant is requesting site plan approval for a 2,470 square foot retail bank building. The <br />bank features a drive-through component.
