Apple Academy <br />Page 7 <br /> <br />The applicant will need to apply for a MnDOT drainage permit to ensure that current <br />drainage rates to MnDOT right-of-way will not be increased. The City will need to <br />receive a copy of this permit in advance of any work taking place. <br /> <br />Utilities <br /> <br />The site is served by existing local utilities. The applicant is proposing to vacate a <br />permanent utility easement that runs south to north through the site under the location of <br />the proposed building. The existing sanitary sewer main will be removed and rerouted <br />around the proposed building. A sanitary sewer service will be extended from the <br />infrastructure located on the north side of the property with a 6-inch service extended <br />into the site. As outlined in the Development Agreement, a letter of Credit will be <br />required for the removal and relocation of the public sanitary sewer. <br /> <br />Vehicular Access <br /> <br />The subject site abuts U.S. Highway 61 to the west. The applicant will remove the <br />existing gravel access onto Highway 61 from the property and will access their site <br />through the TGK Automotive site. The developer is proposing a 24-foot wide drive <br />connection from the subject site to the TGK property. Cross access agreements with the <br />landowner of the TGK Automotive site will be required. <br /> <br />Parcels A and B (the subject site) are separated from Parcel C by a strip of property with <br />a private road easement. As part of the site plan review process, city staff asked the <br />developer to clarify the development team’s intended process to obtain the right for <br />Parcel C to cross the strip of property. Parcel C is not part of this application, however, <br />Parcel C will not receive future access to U.S. Highway 61, so it is imperative that Parcel <br />C enter into cross access agreements for across the gap of property, across the Apple <br />Academy site and the TGK Automotive site. <br /> <br />Additional access concerns were raised for the two residential properties directly to the <br />east that are served by the gap of property and not deeded right-of-way. The City of <br />Hugo requested that the applicant provide a title opinion for the three properties owned <br />by Premier Bank (parcels A, B and C) and for the gravel road. The applicant provided <br />exhibits that addressed access rights, noting that a 30-foot roadway easement was <br />placed over the gravel road. A description of the private road easement was found within <br />the deeds for both residential parcels. <br /> <br />The City Engineer has reviewed the proposed access points for safety and visibility and <br />finds them to be appropriately located. <br /> <br />Trash Enclosures <br /> <br />The trash and recycling enclosures are proposed to be constructed of materials to match <br />the principal building and will be located on the southern border of the parking lot area <br />and connected via sidewalks to the building. As proposed, the trash and recycling <br />enclosure complies with ordinance requirements. <br /> <br /> <br /> <br /> <br />
