<br /> <br /> <br />Apple Academy 3 <br />in accordance with the plans approved and listed on Exhibit A, subject to all City Resolutions and <br />approvals listed in Exhibit B, subject to final approval by the City, and in accordance with City <br />standards and requirements including those listed herein. In addition, all public street, utility, and <br />storm drainage improvements shall comply with the City’s adopted Specification Book and the <br />direction of City staff. <br /> <br /> 3. Authorization to Proceed with Construction. Developer agrees not to <br />commence any grading, utility or street work within the site until the following are completed: <br /> 1) Construction plans are approved by the City and distributed. <br /> 2) Pre-construction conference is held. <br /> 3) Notice to Proceed is issued. <br /> <br /> 4. Construction Observation. The City, for its benefit, will provide staff of its <br />choosing to provide construction observation for the public street, utility, and storm drainage <br />improvements outlined in this agreement. All costs associated with construction observation and <br />inspection will be the responsibility of the Developer. The Developer shall allow to the City staff and <br />City consultants access to the property to allow for this work to occur. <br /> <br /> 5. Miscellaneous Requirements. <br /> <br /> a) Property Corners: All property corners as identified on the site plan <br />must be monumented with iron surveyor's pipes by the Developer prior to final project acceptance of <br />the development. <br /> b) Drainage Easements: Drainage easements shall be given so as to <br />cover wetlands and stormwater ponding areas based upon 100-year high water levels. <br /> c) Soils Testing: Soils inspection and compaction testing by a registered <br />professional engineer shall be accomplished on all lots where filling is required, in accordance with <br />the approved Grading Plan. A minimum of one (1) compaction test for all developed lots shall be <br />obtained for every two (2) foot increment of fill that is placed. A summary of all inspections and <br />compaction tests for all developed lots shall be provided to the City upon completion of the grading. <br />Soil compaction tests shall be provided for respective lot prior to the issuance of a building permit for <br />each respective lot. <br /> d) Private Utilities: All utilities, including electricity, telephone, natural <br />gas and cable television, shall be installed underground. <br /> e) Mailboxes: Developer shall coordinate mailbox locations with the <br />Postmaster. <br /> f) Working Hours: Construction activity, including equipment startup <br />and fueling, can only occur between the hours of 7:00 a.m. and 7:00 p.m. Monday through Friday;
