RESOLUTION 2020- <br />APPROVING PUD GENERAL PLAN FOR ANTHONY HARMENING, FOR <br />"SHORE OF EGG LAKE" ON PROPERTY LOCATED SOUTH OF 147TH <br />STREET NORTH AND EAST OF HIGHWAY 61 (FOREST BOULEVARD <br />NORTH) <br />WHEREAS, Anthony Harmening, has requested approval of a PUD general plan to allow <br />the development of a an approximately 5,700 square foot restaurant with an <br />approximately 4,000 square foot event center and three retail buildings totaling <br />approximately 10,100 square feet on a 4.2 acre property legally described as follows: <br />(See Attached) <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Anthony Harmening, subject to the following conditions: <br />1. A PUD general plan is approved to allow the development of a restaurant with event <br />center and three retail buildings. The development shall be constructed in accordance <br />with the application and plans received by the City on January 17, 2020, and April 10, <br />2020, except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested rezoning of the <br />4.2 acre property and preliminary plat. <br />3. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />4. The developer shall comply with all conditions in the resolution for the site plan and <br />preliminary plat (Resolution #2020- and Resolution #2020-__) <br />5. The developer shall comply with all conditions in the City Engineer's letter dated <br />April 1, 2020. <br />6. The developer shall comply with all items in the MnDOT letter dated February 26, <br />2020. All access points require a permit to be issued from MnDOT. <br />7. The dock and boardwalk shall be reviewed and approved by the MnDNR and the <br />Technical Evaluation Panel (TEP) <br />
