RESOLUTION 2020 - 45 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR HUGO <br />GARDEN APARTMENTS, LLC. FOR "HUGO GARDENS" ON PROPERTY LOCATED <br />WEST OF FINALE AVENUE AND NORTH OF 146T" STREET <br />WHEREAS, Hugo Garden Apartments, LLC. has requested approval of a Final Plat to <br />create one lot and one outlot on property legally described as follows: <br />Outlot B, LaValle Fields First Addition <br />WHEREAS, the Planning Commission has reviewed the preliminary plat and planned <br />unit development (PUD) amendment at a duly called public hearing and recommended <br />approval of the preliminary plat and PUD amendment; and <br />WHEREAS, the City Council approved the preliminary plat and PUD amendment at its <br />meeting on July 20, 2020. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by Hugo <br />Garden Apartments, LLC. for a Final Plat, subject to the following conditions: <br />A final plat is approved to allow the creation of one lot and one outlot, in accordance <br />with the application and plans received by the City on July 24, 2020, and revision <br />received on August 10, 2020, except as amended by this resolution. <br />2. The development shall substantially comply with all plans and conditions of the PUD <br />and preliminary plat approval granted by the City on July 20, 2020. <br />3. Development standards shall be as approved PUD amendment approvals dated July <br />20, 2020. <br />4. Approval of the final plat is contingent upon approval of the easement vacation. <br />5. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions. <br />a. The plans must comply with LaValle Fields PUD approvals in Resolution 2014- <br />03, except as amended by this resolution. <br />b. The plans must be revised to comply with the City Engineer's memo dated <br />August 13, 2020 and the redline comments that were sent directly to the <br />applicant's engineer. <br />c. The developer is responsible for improvements to Finale Avenue as required by <br />Resolution 2014-05 approving the PUD for LaValle Fields, except as otherwise <br />modified in the development agreement for Hugo Gardens. Additionally, <br />i. The Finale Avenue street design shall be revised to show on street <br />parking on the east side of the street. <br />ii. The Finale Avenue street width shall be increased to 32-feet to provide <br />space for the on street parking. <br />iii. The plans should show the planned trail east of Finale Avenue. <br />
