Resolution 2020-45 <br />Page 4 <br />w. The applicant must submit an application for Vacation of the existing easement in <br />the west portion of the site with the Final Plat application. <br />x. The developer must provide easements from property owner to the south to <br />provide access to the driveway and a trail along the east side of the stormwater <br />pond on their property. <br />y. The developer shall enter into an assessment agreement for the trunk water and <br />sewer fees in the amount of $114,944. The agreement is subject to review and <br />approval by the City Council and must be approved prior to issuance of building <br />permits. The following trunk fees must be paid: <br />i. Trunk Sewer = $ 52,224.00 <br />ii. Trunk Water = $62,720.00 <br />z. The City shall agree on a cost share for stormwater management and stormwater <br />reuse. <br />i. The City shall contribute $136,000 to stormwater management. <br />ii. A stormwater oversizing credit of $10,002.70 shall be applied. <br />iii. If the developer does not execute the stormwater reuse agreement and <br />connect to the system, they will be responsible for repayment of the credits. <br />aa. The developer shall provide a development phasing plan for City review. <br />bb. The City's development fees will apply to this project. The fee amounts will be <br />calculated and included as part of the Development Agreement. <br />6. Prior to issuance of building permits: <br />a. The final plat and easement vacation must be approved and filed at Washington <br />County. <br />b. The development agreement must be executed and financial guarantees in <br />place. <br />c. A complete set of revised plans addressing the conditions of approval shall be <br />submitted for city approval. <br />d. The applicant shall obtain all necessary local, state, and federal permits. <br />e. The developer must obtain all necessary stormwater management and WCA <br />permits from the City. <br />f.
