The property is unique as it is located in an area that has existing <br />metal buildings (pole barns). The applicant is proposing to use a high quality metal and <br />the buildings are not designed to be pole barns. <br />Because of the unique location of the site along 130th Street there is an opportunity to use <br />innovative building materials that might not meet the strict intent of the ordinance in <br />regards to it being metal. The proposed building material is high quality and the building <br />design is attractive, which meet the intent of the ordinance to ensure high quality design <br />and building materials for commercial and industrial buildings <br />c. Character of Neighborhood. The variance, ifgranted, will not alter the essential <br />character of the neighborhood. <br />The property is located on the northeast corner of 130th Street and Fenway Boulevard. It <br />is adjacent to existing metal buildings and across the street from a townhome <br />development that that uses vinyl siding for the exterior. Allowing the use of the high <br />quality architectural metal panels will provide a good transition between these uses and <br />will not alter the essential character of the neighborhood. <br />(3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and intent <br />of this chapter and with the policies of the City's Comprehensive Plan. <br />The purpose and intent of the guidelines and ordinance are to ensure high quality design and <br />building materials for commercial and industrial buildings and to improve the overall quality of <br />development in the City. The ordinance was created to prevent the construction of tin sheds and <br />pole barns and the use of low quality metal products. <br />The proposed architectural metal panels are high quality, the building design is attractive, and the <br />architectural details break-up the building, meeting the spirit and intent of the ordinance. <br />(4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use <br />prohibited in the district. <br />Office/warehouse buildings are allowed in the I-3 zoning district. <br />(5) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood <br />protection than required by this chapter. The variance shall be determined the minimum <br />necessary, considering the flood hazard, to afford relief, and the variance shall not be issued <br />within any designated regulatory floodway if any increase in flood levels during the base flood <br />discharge would result. <br />The property is not within a floodplain. <br />(6) Septic and Well Compliance. The sewage treatment system and water system of the subject <br />property is in compliance with city and state codes. <br />The property will be served by City sewer and water. <br />
