RESOLUTION 2020- <br />APPROVING A VARIANCE FOR VICTOR LAND HOLDINGS, LLC FOR <br />THREE OFFICE/WAREHOUSE BUILDINGS ON THE PROPERTY LOCATED <br />NORTHEAST OF 130TH STREET NORTH AND FENWAY BOULEVARD <br />NORTH <br />WHEREAS, Victor Land Holdings, LLC, has requested approval of a variance to allow a <br />higher percentage of metal on a the building than required by ordinance, on the property <br />legally described as; <br />See Attached <br />WHEREAS, the Planning Commission has reviewed said variance at a duly called a <br />public hearing on September 24, 2020, and recommends approval subject to the findings <br />listed in this resolution. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance for Victor Land Holdings, LLC, to allow a higher percentage of metal on a the <br />building than required by ordinance with the following findings: <br />The applicant shall revise the architectural plans to incorporate brick, block, or <br />stone to the base of the building at least 3 feet in height on each side of the <br />buildings to be reviewed and approved by staff. <br />2. The proposed variance is permissible by law. <br />3. According to the ordinance, 20% of the facade of building are allowed to be <br />metal. Metal is an allowed material up to a certain percent. The applicant would <br />like to use a higher percentage of metal. The proposed metal is architectural and <br />high quality rather than the use of metal that ordinance is generally designed to <br />prevent (i.e., tin shed/pole barn). If the applicant incorporates brick, block, or <br />stone to the base of the building at least 3 feet in height on each side of the <br />buildings, it is in staff s opinion that the property owner is proposing to use the <br />property in a reasonable manner. <br />4. The proposed architectural metal panels are unique in that they are not the type of <br />metal that is that the ordinance is generally designed to prevent (i.e., tin <br />shed/pole barn). The proposed material is high quality and has gradually been <br />used more on commercial and industrial projects. The property is unique as it is <br />located in an area that has existing metal buildings (pole barns). The applicant is <br />proposing to use a high quality metal and the buildings are not designed to be <br />pole barns. <br />
