NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY HUGO, MINNESOTA: acquisition is hereby  <br />authorized as follows:  <br />1. Offers shall be made for the necessary easements for the parcels identified in Exhibit A, pursuant to  <br />Minnesota Statute 117.036.  <br />2. If negotiation does not result in the in the prompt acquisition of the easements, staff is authorized and  <br />directed without further action from the City Council to proceed with eminent domain pursuant to MN  <br />State Statute 117 et. Seq. while continuing to work towards a negotiated settlement.  <br />3. Pursuant to Minnesota Statute 117.042, 117.043, it is necessary that the City acquire title and possession  <br />prior to filing of an award and so the City shall proceed with “Quick‐Take” acquisition as to all parcels and  <br />the City shall pay to the Owner or deposit with the Court an amount equal to the City’s approved  <br />appraisal value.103  <br />  <br />This resolution was adopted by the City Council of the City of Hugo on the      day of February, 2021, by  <br />a vote of      Ayes and      Nays  <br />  <br />         __________________________   <br />           , Mayor  <br />  <br />ATTEST:  <br />  <br />  <br />_____________________________________  <br />  <br />, City Clerk  <br />  <br />  <br />
