Xcel Energy – Variance and CUP Amendment <br />the neighborhood. The additional training facilities will not drastically change the <br />appearance of the site. <br /> <br />It is in staff’s opinion that it is reasonable for the applicant to request training facilities that are <br />similar to existing live operational utility poles to ensure adequate training opportunities. The <br />proposed transmission line will not noticeably alter the character of the neighborhood as they <br />will be located behind the principal building and are not structures occupying a large footprint. <br />Additionally, utility poles are common throughout the City. <br /> <br />(3) Spirit and Intent. The granting of the variance would be in keeping with the spirit and <br />intent of this chapter and with the policies of the City’s Comprehensive Plan. <br /> <br />The spirit and intent of the ordinance is to allow the training center on site. <br />(4) Prohibited Use. The variance, if granted, shall not have the effect of allowing any use <br />prohibited in the district. <br />The training center is a permitted use in the Business Park zoning district. <br />(5) Hazard Consideration. The variance, if granted, shall not permit a lower degree of flood <br />protection than required by this chapter. The variance shall be determined the minimum <br />necessary, considering the flood hazard, to afford relief, and the variance shall not be issued <br />within any designated regulatory floodway if any increase in flood levels during the base flood <br />discharge would result. <br />The property is not located within a FEMA designated floodplain. The proposed utility pole <br />locations have been reviewed and approved by the City’s wetland specialist. <br />(6) Septic and Well Compliance. The sewage treatment system and water system of the subject <br />property is in compliance with city and state codes. <br /> <br />The property is served by City sewer and water. <br /> <br />It is in staff’s opinion that the application meets the criteria outlined in the City Code to approve <br />a variance. <br /> <br />5. CONCLUSION: <br /> <br />Staff finds that the proposal meets all the requirements necessary for the City to approve the <br />CUP amendment and variance as outlined in the City Code and zoning district regulations, <br />subject to the conditions listed in the attached resolutions. <br /> <br />6. PLANNING COMMISSION RECOMMENDATION: <br /> <br />The Hugo Planning Commission recommends approval of the CUP amendment and variance for <br />Xcel Energy training facilities located at 13620 Fenway Boulevard North. <br /> <br />
