<br /> <br />Acres of Bald Eagle 3 <br />improvements shall be constructed and installed pursuant to the terms and conditions herein set <br />forth in accordance with the plans approved and listed on Exhibit A, subject to all City Resolutions <br />and approvals listed in Exhibit B, subject to final approval by the City, and in accordance with City <br />standards and requirements including those listed herein. In addition, all public street, utility, and <br />storm drainage improvements shall comply with the City’s adopted Specification Book and the <br />direction of City staff. The only “improvements” to be completed by the developer under this <br />Development Agreement grading for the building pads and stormwater management facilities. All <br />other improvements will be completed with the 121st Street and acres of Bald Eagle public <br />improvement project. Any changes to the plans listed under Exhibit A are subject to approval by <br />the City Engineer. <br /> <br /> 3. Authorization to Proceed with Construction. Developer agrees not to <br />commence any grading, utility or street work within the plat until the following are completed: <br /> 1) Construction plans are approved by the City and distributed. <br /> 2) Pre-construction conference is held. <br /> 3) Notice to Proceed is issued. <br /> <br /> 4. Construction Observation. The City, for its benefit, will provide staff of <br />its choosing to provide construction observation for the public street, utility, and storm drainage <br />improvements outlined in this agreement. All costs associated with construction observation and <br />inspection will be the responsibility of the Developer. The Developer shall allow to the City staff <br />and City consultants access to the property to allow for this work to occur. <br /> <br /> 5. Miscellaneous Requirements. <br /> <br /> a) Property Corners: All property corners as identified on the plat <br />must be monumented with iron surveyor's pipes by the Developer prior to final project acceptance <br />of the development. <br /> b) Drainage Easements: Drainage easements shall be given so as to <br />cover wetlands and stormwater ponding areas based upon 100-year high water levels. <br /> c) Soils Testing: Soils inspection and compaction testing by a <br />registered professional engineer shall be accomplished on all lots where filling is required, in <br />accordance with the approved Grading Plan. A minimum of one (1) compaction test for all <br />developed lots shall be obtained for every two (2) foot increment of fill that is placed. A summary <br />of all inspections and compaction tests for all developed lots shall be provided to the City upon <br />completion of the grading. Soil compaction tests shall be provided for respective lot prior to the <br />issuance of a building permit for each respective lot. <br /> d) Private Utilities: All utilities, including electricity, telephone, <br />natural gas and cable television, shall be installed underground.
