Request for Variance, Property Line <br />Adjustment, Minor Subdivision, Preliminary Plat, Final Plat, and Development <br />Agreement for a residential development to be known as “Acres of Bald Eagle” <br />consisting of 9 single family homes on approximately 13 acres (3 existing lots) of <br />property located north of 121st Street North and West of Falcon Avenue North. <br /> <br />DATE: July 14, 2021, for the City Council Meeting of July 19, 2021 <br /> <br />ZONING: Large Lot Single Family Residential (R-1) <br /> <br />LAND USE: Very Low Density Residential (VLD) <br /> <br />REVIEW DEADLINE: July 22, 2021 (120-days) <br /> <br /> <br />1. PLANNING COMMISSION MEETING UPDATE: <br /> <br />At its July 8, 2021, meeting the Planning Commission held a public hearing and considered the <br />request. Staff recommended approval of the applications subject to the conditions in the <br />resolutions. There were several residents that spoke during the public hearing on a variety of <br />topics. The concerns were regarding the amount of height of homes, wildlife, preservation of <br />trees, grading, drainage, and flooding. <br /> <br />Staff stated that the maximum height of the homes is required to be 35 feet on all of the lots <br />except lots 8 and 9 where a maximum of 25 feet is required by ordinance in the shoreland <br />overlay district. The applicant is proposing to remove a several trees on the west side of the <br />development in the area of lots 1-7. This is due to the grading and the stormwater management <br />facilities for the site. The applicant stated that they are working with their engineer and tree <br />company to save as many trees has they can. Staff stated that the residents should expect the <br />several trees will be removed. The residents to the north stated they wanted to ensure the trees on <br />their property were not damaged during construction. Staff stated that they are working with the <br />applicant to pull the grading away from the adjacent property lines. There were also a few <br />residents concern about the drainage and flooding of their property because of the development.
