Acres of Bald Eagle <br />Page 2 <br /> <br />Staff stated that the drainage will remain on the development property and is required to meet all <br />stormwater management regulations determined by the Rice Creek Watershed District (RCWD). <br /> <br />The Planning Commission reviewed all of the questions and concerns again with staff. Two <br />Commissioner’s stated they think there is an effort from the applicant to save the trees they can <br />on the property. One Commissioner stated they think the applicant has created a development <br />that will fit in with the character of the area. The Planning Commission had questions about the <br />drainage, however stated they have confidence in the engineering design. <br /> <br />The Planning Commission agreed that the requirements were met to approve the applications. <br />The Planning Commission unanimously recommended approval of the Variance, Property Line <br />Adjustment, Minor Subdivision, and Preliminary Plat, for a residential development to be known <br />as “Acres of Bald Eagle” <br /> <br />2. DESCRIPTION OF REQUEST: <br /> <br />The applicant is requesting approval of a property line adjustment, variance, minor subdivision, <br />preliminary plat, final plat, and development agreement for a residential development to be <br />known as “Acres of Bald Eagle” consisting of 9 single family homes on approximately 13 acres <br />of property. <br /> <br />3. BACKGROUND: <br /> <br />Earlier this year the Planning Commission reviewed a sketch plan for this property and provided <br />informal comments to the applicant on the plan. The sketch plan was completed to get comments <br />from the Planning Commission and City Council prior to moving forward with the formal <br />development approval process. The proposed development looks very similar to the sketch plan. <br /> <br />The Planning Commission and City Council generally thought that the layout of the development <br />was in character with the surrounding neighborhood. They stated that the variance for the lots to <br />the west seemed reasonable because of the unique shape and access points of the property. The <br />utilities would need to be extended past several properties that are not included in the in the <br />sketch plan. The applicant met with the surrounding property owners and indicated that some of <br />the property owners are interested in connecting to municipal sewer and/or water if they were to <br />become available, with possible assessments. In this case, the construction cost would be paid <br />with assessments. They City Council discussed the road and utility construction that is required <br />for development of the property and stated that since there is some interest from adjacent <br />property owners for connection to sewer and water that a neighborhood meeting should be held. <br /> <br />In April staff held a neighborhood meeting to gage interest from the adjacent properties to <br />construct a public improvement project for sewer and water with assessments to those properties. <br />Staff provided high-level cost estimates for the assessments for the project. There were several <br />questions from the property owners on the project and assessments. The neighborhood meeting <br />went well and there were several properties owners interested a public improvement project with <br />assessments. There was general consensus to move forward with the public improvement project. <br />
