Acres of Bald Eagle <br />Page 3 <br /> <br />The developer will be responsible for the any improvements that are required with the <br />development, including the paving of 121st Street. If the development does not move forward, <br />the public improvement project will not move forward. <br /> <br />4. CONTEXT: <br /> <br />A. Surrounding Land Use and Zoning <br /> <br />The properties surrounding the proposed development are zoned Large Lot Single Family <br />Residential (R-1) and are occupied by single family homes. <br /> <br />B. Natural Site Characteristics <br /> <br />There is a large wetland in the center of the development site. The applicant is not proposing to <br />impact the wetland. There are several trees and brush on the property. <br /> <br />5. ANALYSIS: <br /> <br />A. Level of City Discretion in Decision-Making <br /> <br />The City’s discretion in approving or denying a variance is limited to whether or not the <br />proposed project meets the standards in the Zoning Ordinance for a variance. The City has a <br />higher level of discretion with a variance because the burden of proof is on the applicant to show <br />that they meet the standards for variances in the ordinance. <br /> <br />Where adjacent property owners desire to adjust their mutual lot line without creating a new <br />parcel or lot of record, they may request a property line adjustment. <br /> <br />The City has limited discretion in approving or denying a minor subdivision application. The <br />City’s discretion is limited to whether or not the proposed subdivision meets the standards <br />outlined in the Comprehensive Land Use Regulations. If it meets these standards, the City must <br />approve the subdivision. <br /> <br />The City has limited discretion in approving or denying a preliminary plat and final plat is <br />limited to whether or not the proposed plat meets the standards outlined in the Comprehensive <br />Land Use Regulations. If it meets these standards, the City must approve the preliminary plat <br />and final plat. <br /> <br />B. Consistency with Ordinance Standards <br /> <br />Variance, Property Line Adjustment, Minor Subdivision, Preliminary Plat, and Final Plat <br /> <br />The property line adjustment, variance and minor subdivision relate to the existing property to <br />the west and an adjacent property along 121st Street. <br />
