Lutz Shared Driveway CUP <br /> <br />3. CONTEXT: <br /> <br />A. Surrounding Land Use and Zoning <br /> <br />The properties are zoned Agricultural (AG) and are guided as Agricultural in the 2040 Land Use <br />Plan. Both properties are over 20 acres and are currently vacant. The surrounding properties are <br />also zoned AG and are large lots that are either vacant or occupied by single family homes. <br /> <br />B. Natural Characteristics of Site <br /> <br />The properties are along the east side of South School Section Lake. They include vegetation and <br />wetlands along the western portion of the sites. <br /> <br />4. LEVEL OF DISCRETION IN DECISION-MAKING: <br /> <br />The City’s discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the Zoning Ordinance. If it meets <br />these standards, the City must approve the conditional use permit. <br /> <br />5. ANALYSIS: <br /> <br />A. Consistency with Ordinance Standards <br /> <br />Staff used these standards to review the application and found that the request meets all <br />applicable standards as follows: <br /> <br />1. The proposed use is permissible by law. <br /> <br />The proposed use is allowed by conditional use permit. <br /> <br />2. The proposed use is keeping with the spirit and intent of the ordinance. <br /> <br />The proposed use is allowed in the AG zoning district and will keep with the spirit and intent of <br />the ordinance, which is intended to allow a shared driveway by a CUP as long as they comply <br />with the regulations. <br /> <br />3. The proposed use is compatible with the City’s Comprehensive Plan and the character of the <br />surrounding area. <br /> <br />The use is existing and is compatible with the Comprehensive Plan and the shared driveway will <br />not alter the character of the area. There are shared driveways in the area that provide access to <br />land locked parcels. <br /> <br /> <br />
