White Bear Lake School District Elementary School <br />Page 2 <br />B. Natural Characteristics of Site <br />The property totals approximately 135 acres. Large portions of the site are covered by wetlands <br />to the west and south. No wetlands will be impacted with this project. The buildable portion of <br />the site is to the northeast and is approximately 27 acres. <br />3. ANALYSIS: <br />A. Level of City Discretion in Decision -Making <br />The City's discretion in approving or denying a site plan is limited to whether or not the <br />proposed project complies with the Comprehensive Plan and Zoning Ordinance requirements. If <br />it meets these standards, the City must then approve the site plan. <br />The City's discretion in approving or denying a conditional use permit is limited to whether or <br />not the proposed application meets the standards outlined in the City's Comprehensive Land Use <br />Regulations. If it meets these standards, the City must then approve the conditional use permit. <br />B. Consistency with Ordinance Standards <br />Property Line Adjustment <br />Xcel Energy owns property on the north side of the school property and through the western <br />portion of the school property. The White Bear School District and Xcel Energy have applied for <br />a property line adjustment to allow the District to acquire the property and in turn provide Xcel <br />with an easement for utility purposes. The requests meets all of the requirements necessary to <br />approve the property line adjustment. <br />Conditional Use Permit <br />Schools are allowed in the R-3 zoning district as a conditional use. There are criteria that is <br />evaluated for the conditional use permit and the applications meet the necessary criteria to <br />approve a permit. Staff evaluated the project subject to the criteria below: <br />1. The proposed use is permissible bylaw. <br />The use is permissible by law. <br />2. The proposed use is in keeping with the spirit and intent of this chapter. <br />The spirit and intent of the ordinance is to allow a school in the R-3 zoning district as a <br />conditional use.
