Miron Farmhand Living Quarters IUP <br />3. LEVEL OF DISCRETION IN DECISION -MAKING: <br />The City's discretion in approving or denying an interim use permit is limited to whether or not <br />the proposed application meets the standards outlined in the Zoning Ordinance. If it meets these <br />standards, the City must approve the interim use permit. <br />4. ANALYSIS: <br />A. Consistency with Ordinance Standards <br />Staff used these standards to review the application and found that the request meets all <br />applicable standards as follows. <br />On properties 20 acres or more in size, located in the future urban service, rural residential, <br />agricultural, and long term agricultural districts a second dwelling shall be allowed for living <br />quarters for a farmhand. The second dwelling shall only be allowed with approval of an interim <br />use permit upon finding that the following conditions have been met: <br />1. The primary use of the property shall be a bona fide agricultural operation of sufficient <br />size to necessitate the assistance of a farmhand. <br />The property is currently operated as an agricultural dairy farm. This is a large operation with <br />existing assistance from employees and family members. <br />2. The living quarters shall be for employees hired to conduct work on the farm or members <br />of the family. <br />The living quarters will be occupied by members of the family that assist on the farm. <br />3. The living quarters shall not be used or rented out for any purpose other than <br />agriculture. <br />This is listed as a condition in the interim use permit. <br />4. The living quarters shall meet all zoning and building code requirements. <br />This is listed as a condition in the interim use permit. <br />S. There shall be no variances involved in the request. <br />No variances are requested with this application. <br />6. Within 12 months of the date that agricultural operations on the property cease, the <br />second dwelling shall be removed or the property shall be subdivided and meet all code <br />requirements. <br />This is listed as a condition in the interim use permit. <br />
