<br /> <br />Victor Land Holdings, LLC 4 <br />respective lot. <br /> d) Private Utilities: All utilities, including electricity, telephone, <br />natural gas and cable television, shall be installed underground. <br /> e) Mailboxes: Developer shall coordinate mailbox locations with the <br />Postmaster. <br /> f) Working Hours: Construction activity, including equipment <br />startup and fueling, can only occur between the hours of 7:00 a.m. and 7:00 p.m. Monday through <br />Friday; 8:00 a.m. and 5:00 p.m. on Saturdays; at no time on Sundays or holidays. <br /> g) Street Sweeping: Developer shall sweep and/or otherwise clean all <br />streets, as needed, within and adjacent to the Development property as a result of construction <br />activities associated with the project until final acceptance of the improvements. If the streets are <br />not maintained in a manner acceptable to the City, the City will arrange for the street sweeping at <br />Developer’s cost. <br /> <br /> 6. Project Completion: All work for improvements listed herein on Exhibit A, <br />including street, sanitary sewer, storm sewer, and municipal water, shall be completed subject to the <br />approval of the City in accordance with the approved plans. All improvements shall be <br />substantially completed to the reasonable satisfaction and approval of the City within twelve (12) <br />months of the execution of this agreement. The Developer shall be excused from the strict <br />completion date set forth herein if written notice is received from the Developer of the existence of <br />causes over which the Developer has no control which will delay the completion of the work and <br />approved in writing by the City. In that event, the City may extend the date or dates herein <br />specified. <br /> <br /> 7. Construction Warranty <br /> <br /> The developer’s engineer shall certify that grading within the project was completed in <br />accordance with the approved grading plan before the City issues any building permits. The <br />developer shall remain ultimately responsible for accurate grading of all lots and shall correct any <br />deficiencies in grading that may be discovered until the certificate of occupancy is issued or the <br />developer is released from its obligation under this agreement as outlined in paragraph 7 above. <br /> <br /> 8. Drainage Easements. <br /> <br /> a) Work within Easements: No improvements, landscaping, or grading, <br />other than improvements shown on the approved plans, shall be permitted in defined drainage <br />easements without the prior written permission of the City and any regulatory agency having <br />jurisdiction. <br /> b) Maintenance Responsibilities: The Developer and its successors in
