<br /> <br />Victor Land Holdings, LLC 5 <br />interest shall be responsible for routine maintenance of all storm water management ponds, <br />wetlands, and drainage areas within easements dedicated to the City on their property. Routine <br />maintenance shall include litter removal, mowing and maintenance of the property adjacent to pond <br />or wetland areas. In the case of drainage swales, routine maintenance includes the removal of <br />obstructions from the swale as necessary to maintain proper drainage in addition to the <br />aforementioned items. The developer shall be responsible for non-routine maintenance of storm <br />water ponds within the easements, including pond dredging, maintenance of the storm water inlet(s) <br />and outlet(s) pipes, and erosion control at outlet and inlet locations. Such maintenance shall be <br />completed as deemed necessary by the City. <br /> <br /> 9. Lowest Floor Elevations. All minimum floor elevations shall comply with Hugo <br />City Code, the City’s Comprehensive Stormwater Management Plan, or the approved Grading Plan, <br />whichever is more restrictive. Except as may be specifically allowed under Exhibit A, no building <br />shall be constructed herein unless the lowest floor elevation is at least three (3) feet above the 100- <br />year flood elevation or four (4) feet above the high groundwater elevation, whichever is greater, for <br />the subject property. <br /> <br /> 10. Landscaping. All disturbed areas within the project shall be landscaped in <br />accordance with the approved landscape plans and the City’s Landscape Ordinance. All <br />landscaping shall be complete, established and growing within sixty (60) days of issuance of a <br />Certificate of Occupancy, except that, if the Certificate of Occupancy is issued between the dates of <br />October 1 and May 1, then the landscaping required herein shall be complete, established and <br />growing no later than July 1. Unless specific arrangements are made and agreed to by the City, all <br />landscaping installed within the project shall be maintained by the developer and its successors. <br /> <br /> All areas, other than proposed street areas, disturbed by grading activities on the site shall be <br />seeded. Seeding shall be immediate upon completion of grading activities or as directed by the City <br />Engineer. <br /> <br />B. ESCROWS, CHARGES AND UTILITY OVERSIZING: <br /> <br /> Developer shall pay the escrows, fees and charges listed on Exhibit C. <br /> <br />C. SPECIAL PLANNING REQUIREMENTS: <br /> <br /> The development shall be built and maintained in accordance with the planning <br />requirements listed on Exhibit A hereto, and any miscellaneous requirements listed on Exhibit B <br />hereto. <br /> <br />D. ADMINISTRATIVE REQUIREMENTS:
